Broker Fee Agreement

1. Overview

This Broker Fee Agreement (“Agreement”) governs the terms under which registered customs broker firms participate in the DutyClaims platform. By registering as a broker, you agree to these fee terms, commission structure, and participation requirements.

2. DutyClaims Platform Fee

DutyClaims charges a fee on IEEPA tariff refund claims recovered through the platform. The standard DutyClaims fee is 2.00% of the gross refund amount recovered. This fee is assessed only when a refund is actually received from U.S. Customs and Border Protection (“CBP”) or through proceedings before the U.S. Court of International Trade (“CIT”).

3. Broker Commission

Registered brokers may earn a commission on claims attributed to them through client enrollment, referral links, or participation tickets. Commission tiers may include:

  • Standard tier: 1.50% of the DutyClaims fee
  • Volume tier: 2.00% of the DutyClaims fee (for example, 10 or more enrolled clients)
  • Strategic tier: 3.00% of the DutyClaims fee (by invitation)

Commission is paid only after DutyClaims receives the refund and following any applicable hold period. Commission rates may be updated from time to time, and brokers will be notified of material changes.

4. Client Attribution

Clients enrolled through your firm, via your referral link, or with a participation ticket linked to your broker account are attributed to you. The attribution window is 90 days from the initial referral or enrollment action. DutyClaims retains final authority to resolve attribution disputes in its reasonable discretion.

5. Responsibilities

As a registered broker, you agree to:

  • Provide accurate firm and contact information
  • Upload only clients who have consented to participation
  • Not misrepresent the platform or refund expectations
  • Cooperate with DutyClaims on claim status, documentation, and operational follow-up

6. Termination

Either party may terminate the broker relationship at any time. Commission on claims already attributed and in progress will be handled under the terms in effect at the time of attribution, unless otherwise agreed in writing.
